One week after a plea agreement for 26-year-old Preston Henry Tolth was rejected by a U.S. District Court Judge, a second agreement was submitted to the court in Phoenix Thursday morning.
Senior Judge Douglas L. Rayes had accepted Tolth’s guilty plea to one count of robbery but deferred the acceptance of the plea agreement until a sentencing hearing scheduled for May 8. The new plea agreement stipulates a maximum sentence of five years, while the recommended sentence is three years, which Tolth has already served since his arrest on April 3, 2023.
